1. Agreement to Terms

By accessing or using the businessfy platform, website (https://businessfy.ai), and associated subdomains (collectively, the “Service”), operated by SMART DYNAMIC SYSTEMS LTD, a company registered in England and Wales under number 16430324, trading as businessfy (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access or use the Service.

2. Description of the Service

businessfy is an Agentic AI Business Operating System that dynamically generates custom operational workspaces, customer relationship management (CRM) views, automated communication workflows, and invoicing integration with Stripe based on natural language prompts.

3. User Accounts and Security

To access features of the Service, you must authenticate via supported single-sign-on (SSO) providers (such as Google OAuth) or create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@businessfy.ai of any unauthorized access or security breach.

4. Subscription, Billing, and Payments

Access to paid tiers and Founding Member cohorts is billed on a recurring subscription or prepaid basis in United States Dollars (USD).

• Payment Processing: All payments and transactions are processed securely via Stripe. We do not store raw credit card details on our servers.
• Billing Descriptor: Charges on your credit card or bank statement will appear as BUSINESSFY or BUSINESSFY.AI.
• Renewal and Cancellation: Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date via your account settings.

5. Intellectual Property and User Content

Your Data: You retain 100% ownership of all business data, customer records, and uploaded materials processed through your workspace. We do not sell your proprietary data.

Platform IP: The businessfy platform, AI agent orchestration algorithms, branding, logos, and UI designs are the exclusive intellectual property of businessfy and protected by international copyright laws.

6. Prohibited Uses

You agree not to use the Service for:

• Any unlawful purpose or in violation of any applicable local, state, national, or international law.
• Transmitting unsolicited marketing spam, fraudulent invoices, or phishing schemes.
• Attempting to reverse engineer, decompile, or extract proprietary code from the agent runtime.
• Impersonating another business entity or misrepresenting transaction terms to end customers.

7. Limitation of Liability

To the maximum extent permitted by law, businessfy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption arising from your use of or inability to use the Service.
